Web Application Standard Terms and Conditions

  • Introduction

    These Web Application Standard Terms and Conditions (these "Terms" or these "Web Application Standard Terms and Conditions") govern your use of the Passive Ka Power mobile web application (referred to as "Application"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Application.

  • Intellectual Property Rights

    Except for content you own and choose to upload or include within the Application, Dhwaj Platform Pvt. Ltd. and/or its licensors own all rights to the intellectual property and material contained in the Application, and all such rights are reserved. You are granted a limited license to access and use the Application for personal, noncommercial use, subject to the restrictions set forth in these Terms.

  • Restrictions

    You are expressly restricted from the following actions concerning the Application:

    1. Republishing any material from the Application without permission;
    2. Selling, sublicensing, or otherwise commercializing Application content;
    3. Publicly performing or showing any material from the Application;
    4. Using the Application in any way that is harmful to the Application or its users;
    5. Using the Application in a manner that disrupts access for other users;
    6. Using the Application contrary to applicable laws and regulations;
    7. Engaging in data mining, harvesting, or extracting from the Application;
    8. Using the Application for unauthorized marketing or advertising purposes.

    Certain areas of the Application may be restricted, and Dhwaj Platform Pvt. Ltd. reserves the right to restrict access further. Any user ID or password for the Application is confidential, and you must maintain its security.

  • Your Content

    “Your Content” refers to any audio, video, text, images, or other material you choose to display or upload within the Application. By uploading Your Content, you grant Dhwaj Platform Pvt. Ltd. a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, and distribute it across all media.

    Your Content must be your own and must not infringe upon any third-party rights. Dhwaj Platform Pvt. Ltd. reserves the right to remove any content at its sole discretion.

  • No Warranties

    The Application is provided "as is," without warranties of any kind, express or implied. Dhwaj Platform Pvt. Ltd. makes no representations or warranties regarding the operation or content of the Application.

  • Limitation of Liability In no event shall Dhwaj Platform Pvt. Ltd. or any of its directors, officers, or employees be liable to you for any direct, indirect, consequential, or special damages arising from your use of the Application, whether under contract, tort, or otherwise.
  • Indemnification

    You agree to indemnify and hold harmless Dhwaj Platform Pvt. Ltd. from and against any and all claims, liabilities, damages, costs, and expenses arising from your breach of these Terms.

  • Severability

    If any provision of these Terms is found to be unenforceable, it will not affect the validity of the remaining provisions.

  • Changes to Terms

    Dhwaj Platform Pvt. Ltd. reserves the right to update these Terms at any time. It is your responsibility to check for updates regularly.

  • Assignment

    Dhwaj Platform Pvt. Ltd. may assign or transfer its rights and obligations under these Terms without notice. You may not assign or transfer your rights under these Terms without prior written consent.

  • Entire Agreement

    These Terms, along with any legal notices and disclaimers found within the Application, constitute the entire agreement between you and Dhwaj Platform Pvt. Ltd. regarding the use of the Application.

  • Governing Law & Arbitration

    These Terms are governed by the laws of India. Any disputes related to the Application will be resolved by arbitration, conducted under the Arbitration and Conciliation Act, 1996, in Mumbai. The language of the arbitration will be English, and the decision of the arbitrator will be final.
